This Streamer Agreement ('Agreement') is entered into by and between ping UG (haftungsbeschränkt) ('Platform Operator') and any individual creator, self-employed artist, or legal entity organizing or broadcasting live content, including but not limited to streamers, event organizers, or media rights holders (collectively, the 'Host'). By setting up a stream on https://www.showpass.live ('Platform'), the Host agrees to the following terms and conditions:

By creating a stream, the Host acknowledges that they have read, understood, and agree to be bound by this Agreement, as well as the Platform's Terms of Service, Privacy Policy, and any other relevant policies.

The Platform does not support permanent content uploads. All content must be delivered through live streams. All restrictions and guidelines apply to the content depicted during these live streams and the respective live stream descriptions being used to promote these streams.

To set up a live stream, the Host can include a promotional text. The Host agrees that this text cannot include or promote any unlawful actions that would also be forbidden to depict within the actual stream. The Host must correctly describe what its audience may expect when buying tickets for that stream. Neither the stream nor the promotional text must promote or suggest any prohibited content.

Unlawful content includes, but is not limited to, any content that:

There must be no CONTENT (images, live streams and/or videos) that can be construed to depict or suggest an illegal activity.

The Host confirms that they (and, where applicable, their legal representatives) are at least 18 years old. The Host further agrees that if other persons (e.g. performers, athletes, artists, participants) are depicted in the stream, the Host is responsible for verifying their identity and obtaining and keeping records of their written consent.

The Host confirms and warrants that all content broadcast via the Platform does not infringe any intellectual property rights. The Host must hold all necessary rights, licenses, and permissions to record, transmit, and monetize the livestream, including but not limited to music rights, broadcasting rights, performance rights, and venue or event licenses.

The Host agrees that they will not show anything other than what is promoted in the upcoming live-stream event and will ensure that the description of the livestream event accurately reflects the content to be broadcast. The Host acknowledges that significant deviations (e.g., early termination of the event, or failure to deliver substantial parts of the advertised program) may entitle the Platform Operator to issue refunds to viewers and to withhold payouts accordingly.

The Host agrees to provide their full name, birthday, and Paxum account details to receive payouts for successful streams.

The Host is solely responsible for the organization, legality, and execution of their livestream. This includes ensuring compliance with all applicable laws and regulations, obtaining and maintaining all required rights and licenses (e.g., broadcasting rights for sports events, music licensing, performer contracts, venue permissions), and ensuring that all content complies with the Platform's Terms and Prohibited Content Policy. The Platform Operator may request documentation proving such rights and may suspend or remove a livestream or account if sufficient proof is not provided.

The Host acknowledges that any violation of the Platform's terms and conditions, particularly regarding pornography or violence, will result in a permanent ban. Such content will not be accepted or tolerated in any way on the Platform.

The Host agrees that the Platform will retain 25% (35% for 4k live streams) of the revenue earned through ticket sales to cover payment processing fees, live streaming services, and platform maintenance. The Host can request payouts only when their balance exceeds USD 100 or EUR 100.
